1. Acceptance of Terms
By downloading, installing, or using Paintrix Studio ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.
3. Subscriptions
Some features of the App require a paid subscription. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings.
4. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of data, artwork, or creative work
- Loss of profits or revenue
- Damage to devices or equipment
- Any other damages arising from the use or inability to use the App
YOU ACKNOWLEDGE THAT YOU ARE SOLELY RESPONSIBLE FOR BACKING UP YOUR WORK. THE DEVELOPER IS NOT RESPONSIBLE FOR ANY LOST, CORRUPTED, OR UNRECOVERABLE FILES OR PROJECTS.
6. Indemnification
You agree to indemnify and hold harmless the Developer from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
7. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to its conflict of law provisions.
Any legal action or proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in Alabama. You hereby consent to the personal jurisdiction and venue of such courts and waive any objection based on inconvenient forum.
8. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.
